A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL OF A CLASS III SUBDIVISION <br />OF OUTLOTS B AND C, OLD CRYSTAL BAY ROAD ADDITION <br />-FILE NO. 1933 <br />WHEREAS, Tandem Propenies and Peter Andrea Company (hereinafter the <br />"subdividers"), on April 26. 1994. filed a formal subdivision application with the City for <br />approval of a 21 lot residential plat of property legally described as: <br />Outlots B and C. Old Crystal Bay Road Addition. Hennepin County. Minnesota <br />(her einafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono ’s Zoning and Subdivision Codes, the Orono <br />Plannine Commission held a public hearing on June 20. 1994. at which time all persons desiring <br />to be helird concerning this application were given the opportunity to speak thereon; and <br />\\HEREAS, at their regular meeting held on June 27, 1994. the Orono City <br />Council considered the subdivision application of the subdividers, noting the following findings <br />of fact; <br />1 <br />3. <br />4. <br />The properties are located within the RR-IB Single Family Rural Residential <br />Zoning District, requiring a minimum of 2 acres of contiguous dry ’ buildable land <br />within each newly created lot. <br />The property contains a total of 57 acres with 7 acres of designated wetland and <br />retention/treatment area. <br />The proposed plat consists of 21 residential lots, each meeting the minimum <br />requirement of 2 acres of dry buildable area. <br />Lots 15 and 18 that abut the cul-de-sac area within the Coffin second phase <br />division do not meet the required lot width of 200' at the rear of the front street <br />setback line. Plannimt Commission recommended approval of the lot width <br />variance as it would bel;onsistent with rural developments where lots are located <br />Pace 1 of 7
