9. <br />12 <br />The developer shall create covenants to be filed on Chuin of Titles of these <br />properties advising future owners of the limitations on the use of these areas and <br />the need to first apply to the Corps of Engineers and the Watershed District if any <br />improvements are proposed at some fumre date before obtaining the necessary <br />permits from the City. Applicant shall provide mapping and metes and bounds <br />description in order to complete covenants. <br />All wetlands designated on City conservation map shall be shown as drainage <br />easements on the plat. There are no designated wetlands within the Dickey <br />property. Lots 1. 2, 7. 8 and 9 of the first phase division of the Coffin property <br />have protected wetlands. <br />Three acre park outlot to remain as park whether there is historical significance <br />or not within the property and that internal trails linking park outlot to DNR <br />parks and Luce Line be dedicated as public. Areas of public interior trails to be <br />excluded from lot areas of each involved lot. <br />A drainage easement shall be required over all retention ponding areas. Such <br />easements to be recorded in the Chain of Title. <br />Developer shall create covenants defining future homeowners association <br />responsibility for upkeep and maintenance of all drainage facilities. <br />The preliminary plat shall be submitted to the City Assessor’s office to determine <br />value of undeveloped land at the time of the preliminary plat. The park <br />dedication fee shall be adjusted to account for a three-acre park outlot and interior <br />public bike trails. <br />Applicant to execute Developer’s Agreement to ensure all grading/drainage <br />improvements aiid road improvements are installed to City ’s satisfaction. No land <br />alterations can take place until erosion control is established and, septic sites <br />fenced and the City is in receipt of final grading and road plans. No <br />improvements can begin until City Engineer has approved all <br />alteration/improvement plans. A Letter of Credit must accompany a fully <br />executed Developer’s Agreement written to 150% of the cost of the proposed <br />road and site improvements. No building permits will be issued until all drainage <br />facilities have been installed and approved and satisfactory road base completed. <br />Page 5 of 9
