Request for Council Action continued <br />page 4 of 10 <br />March 11, 1V94 <br />Zoning File ii^l901 <br />Engineer have asked that the City’s Comprehensive Development Plan for bike trails along Old <br />Crystal Bay Road be implemented by subdivider installing bike trail along east side of Old <br />Crystal Bay Road. <br />Subdivision Reviewed in More Detail <br />Lot configuration - <br />All lots meet the required 2 acres of dry contiguous lands exclusive of designated wetlands and <br />the retention treatment ponds. All lots except for Lot 3 now meet the required lot width at the <br />front/street setback measuring 200’. The following lots are classified as through lots and <br />conditional use permits would be required for any accessory strucmre installed at some future <br />date: Lots 1 and 2. Block 2 and Lots 1, 2, 3 and 4. Block 1. all within the Dickey parcel. Two <br />lots within the Coffin property achieve access via a 30’ wide private driveway outlot. Lots 6 and <br />7. Planning Commission members reviewed the recent code amendment dealing with back lots, <br />specially Section 11.31, Subd. 5(C-1) entitled "Applicability". Planning Commission members <br />felt that the developer had supported the need for the back lot. Section B of code, specifically <br />states that back lot configuration should not be used when dividing a large parcel into numerous <br />lots and may not be used as a tool for the convenience of the developer. Please review Exhibit <br />B, applicant notes that either a loop road or extension of road to west would impact highly <br />sensitive area resulting in the loss of trees on adjacent designated wetland. The extension of <br />roadways would also impact smaller lots in the Cygnet Place neighborhood. Planning <br />Commission agreed with the findings and found the use of back lot configuration to be applicable <br />in this case. Note surveyor has designated the required lot standards at 1505J of the required <br />zoning standards. Side yards adjacent to driveway outlot must be 50’. Surveyor must adjust <br />side yard adjacent to the outlot in Lot 15 to 50’ rather than 30’ as shown. <br />Drainage/Grading/Wetlands <br />Per Council ’s directive, the applicant has filed the preliminary plans for permit approval at both <br />the Minnehaha Creek Watershed, the local governmental unit responsible for implementing the <br />National Wetlands Act, and on the federal level, the Corps of Engineers. The Coips Has advised <br />that the permit review would involve a national-wide permit with approximate ‘ , leview. <br />He noted that if the surveyor/engineer would agree to certain changes in the proposed mitigation <br />plan that a more abbreviated review would be possible. The representative of the Corps said <br />in this case a simple letter would be sent out within a week. He assured staff that since we are <br />dealing with less than 3 acres of disturbed area, the mitigation plan would not require an <br />individual permit review that could take as much a 120 day time period. Uirfer a 30 day nation­ <br />wide j)ermit review, plans and additional submittals are sent to five reviewing agencies - PCA, <br />U.S. Wildlife Service, DNR, State Historical Society and EPC in Chicago.
