Request for Counci* ction C(5iitinued <br />Page 6 <br />November 7. 1995 . <br />Zoning File #2065 Samuel and Joyce Marfield/Douglas and Chery l Hili/William Toles <br />Staff advised Planning Commission that in order to appro\'C the vacation and replat, they must <br />be able to find that: <br />The necessary variances involved in the replat (lot xvidth/frontage^ack lot issues) <br />are clearly justified and supported by adequate findings. <br />It is in the public's best interest to vacate the road. <br />All utilities and access needs will be accommodated. <br />This vacation is unique and supported by compelling justifications that apply to <br />this neighborhood but not to other simila' neighborhoods, in order that a b^is <br />to deny similar requests without such conditions e.xisting, is possible (i.e. show <br />why this vacation does not set a negative precedent). <br />The majority of the Planning Commission felt that the proposal is supported by adequate <br />findings. <br />While the applicants have provided compelling arguments for the proposal and have addressed <br />the issues in great detail, staff is still hesitant to recommend approval mainly due to the access <br />policy issues. Vacating this public road which screes three residences may evei^en the Oty s <br />^sition in requiring creation of new private roads serving three residenees. From a pol.cy <br />^andpoint. allowing additional driveways to aceess directly to a collector road such as Norih <br />Shorrorive may not be in the City's best interest, although m this specific request the <br />justifications may be adequate. <br />Procedurallv if Council concludes that approval is appropriate, conceptual approval of the <br />vacation and preliminary plat approval can be granted per the attached resolution. <br />COUNCIL ACTION REQUESTED: <br />Options for Action <br />1 Adopt the attached resolution conceptually approving the vacation of Scotch Pine Lane <br />and granting preliminarv- plat approval with the conditions noted in that resolution. <br />3. <br />Table for further information. <br />Cancepiual denial, directing staff to draft a resolution specifying the basis for denial. <br />4.Other.
