A RESOLUTION GRANTING CONCEPTUAL APPROVAL OF <br />THE VACATION OF SCOTCH PINE LANE AND GRANTING <br />PRELIMINARY APPROVAL OF A THREE LOT PLAT OF <br />PROPERTY LOCATED WITHIN THE DICON ADDITION <br />-FILE NO. 2065 <br />WHEREAS, Samuel and Joyce Marfield, Douglas and Cheryl Hill, and William <br />Toles (hereinafter the "applicants") on August 15, 1995. filed a formal application with the City of <br />Orono (hereinafter "City") for vacation of the right-of-way of Scotch Pine Lane and for approval of <br />a three lot residential replat of Scotch Pine Lane and residential property located at 2455, 2425 <br />and 2435 Scotch Pine Lane, legally described as follows: <br />Lots 1-4, inclusive. Block 1. Dicon Addition, according to the recorded plat <br />thereof, Hennepin County. Minnesota and all that part of the right-of-way of <br />Scotch Pine Lane, as donated and dedicated by said Dicon Addition, which lies <br />southerly of the northwesterly continuation of the northeasterly line ot said Lot <br />4 (hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono <br />Planning Commission held a public hearing on September 18. 1995 and continued said hearing <br />on October 16, 1995, at which times all persons desiring to be heard concerning this <br />application were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on November 13, 1995, the Orono <br />Citv Council considered the application for public road vacation and replat subdivision, noting <br />the following findings of fact; <br />1.The property is located within the LR-IA Single Family Lakeshore Residential <br />Zoning District requiring a minimum of two acres of contiguous dry buildable <br />land and 200' of width for each building lot. <br />The property contains a total of approximately 3.37 acres, including Lots 1-4 and <br />the right-of-way of Scotch Pine Lane.
