' <br />►>, <br />A RESOLUTION GRANTINC; VARIANCES TO <br />MUNICIPAL ZONING CODE SECTIONS 10.55, SUBDIVISION 8, <br />SECTION 10.22, SUBDIVISION 2, AND SECTION 10.56, SUBDIVISION 16 (J & L), <br />GRANTING A CONDITIONAL USE PERMIT <br />PER SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 2056 <br />WHEREAS, Michael and Barbara Wigley (hereinafter the "applicanls") are owners <br />of the property located at 1035 Tonkawa Road within the Cit>' of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 3, Block 1. Cariwood, Hennepin County. .Minnesota (hereinafter the "property"); <br />and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.55. Subdivision 8, 10.56. Subdivision 16 (J). and 10.22, Subdivision 2 to <br />allow crading for the purpose of constructing retaining w alls within 75’ of the lake w here grading <br />is normally prohibited, and variances to Sections 10.22, Subdivision 2 and 10.5c, Subdivision 16 <br />(L) to allow hardcover associated with such walls within 75’ of the lake where no hardcover is <br />normally allowed, and for a conditional use permit per Section 10.03, Subdivision 19 tor land <br />alteration near the lakeshore. <br />NOW, THEREFORE, BE IT R_ESOL\’ED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. I’his application was reviewed as Zoning File «2056. <br />2. rite propeny is located in the LR-1B Single Family Lakeshore Residential Zoning <br />District. <br />a.The (3rono Planning Commission reviewed this application on August 21, 1995 and <br />auain after revisions by the applicant on October 16, 1995, and recommended <br />approval of the variances as noted above, based upon the follow ing findings: <br />Page 1 of 5
