b. <br />Planning Commission finds no justification for the initially proposed boulder <br />walls at the base of the lakeshore bank, and finds no justification for the <br />proposed excavation of the lakeshore bank to remove poison i\y. <br />Planning Commission finds that construction of a boulder retaining wall at <br />the top of the lakeshore bank will help to prevent surficial erosion from the <br />yard area near the house in the 0-75' zone without significant impact to the <br />lakeshore bank nor to the existing trees and shrubs. <br />Planning Commission finds that the proposed plantings on the slope ot the <br />lakeshore bank are acceptable only in the context of no grading or excavation <br />of the slope. <br />Planning Commission finds that the existing mulched area lined with <br />landscape fabric does not benefit from said fabric which constitutes <br />hardcover, and therefore the fabric should be remo\ ed. <br />Planning Commission finds that the only hardcov er appropriate for the 0-75’ <br />lakeshore setback zone on this property is the 4’ x 40’ existing stairway and <br />the appro.ximately 96 lineal feet ot nominally 2 wide boulder wall proposed <br />at the top of the lakeshore bank. These noted items of hardcover constitute <br />approximately 352 s.t. or 3.7?'o in the 0-75 zone. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, repons by City suiff, comments by <br />the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Tlie City Council finds that granting the v ariances and conditional use pemiit per the <br />revised propt)sal will not be detrimental to the health, safety or general welfare of the <br />public, would not adversely affect light, air nor pose a fire hazard or other danger to <br />neighboring property, nor will its use depreciate surrounding property values and that <br />the proposed level of use of the property will be in keeping with the intent and <br />objectiv es of the Zoning Code and Comprehensive Plan of the City. <br />e. <br />Page 2 of 5
