--ifrxc----r- - r- <br />A RESOLUTION VACATING <br />A DRAINAGE AND UTILITY EASEMENT <br />WITHIN LOTS 2 AND 3, BLOCK 1 OF THE PLAT <br />OF MAPLE PLACE IN THE CITY OF ORONO. <br />HENTSTPIN COUTSTY, MINTsESOTA <br />FILE NO. 2025 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on May 22, 1995, Michael R. Plank filed a petition with the City <br />of Orono requesting the vacation of a 10’ wide drainage and utility easement originally dedicated <br />in the plat of Maple Place and legally described as follows: <br />Drainage and utility easements as dedicated in the plat of Maple Place lying 5’ on each <br />side of the common lot line between Lots 2 and 3, BlcKk 1, Maple Place which bears <br />North 62 degrees 24 minutes West for a distance of 441.99 feet, EXCEPT for that part <br />lying within 5 feet on each side of the common lot line between Lots 1 and 2, said Block <br />1, Hennepin County, Minnesota; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />before the City’s Planning Commission on July 17, 1995 regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommend unanimous approval of the proposed vacation; and <br />WHEREAS, the City Council of the City of Orono finds that said vacation as <br />proposed is in keeping with the public interest and in consideration of the following findings: <br />1. Tlie drainage and utility easements as shown and dedicated in the original plat of <br />Maple Place will no longer be located adjacent to a lot line as division line has <br />been relocated on property. <br />Paee 1 of 2
