V'.': r . <br />League of Minnesota Cities <br />3490 Lexington Avenue North <br />St. Paul, MN 55126-8044 <br />May 16, 1995 <br />To: Ron Morse, City_of Orono <br />From; PeteTritz , <br />Re: Proposed joint powers agreement <br />As you requested, we've reviewed the dreft agreement between the cities of Orono ^ Lons, <br />Lake providing for the adoption and enforcement of watercraft regulations on Long Lake, which <br />lies within both cities. <br />As drafted, the agreement would not create a "joint powers entity" m defin^ tn the LMCIT <br />liability coverage document, since the agreement doesn't create a joint board with the o <br />receive and spend money, enter contracts, hire employees, etc. The coverage document $ joint <br />powers" exclusion therefor would not come into pUy with reg^d to this agre^nt; and Orono s <br />LMCrr liability coverage would therefor respond to claims arising from activities pursuant to this <br />agreement. <br />The only other comments 1 have are very minor. In Section HI. subd. A. If so. it would be a good idea to sUte that explicitly; otherwise, you could <br />concei v^ablv be setting the stage for a finger-pointing contest between the two cities as to who <br />was responsible for signage at a particular site, if a claim were to arise from a signage problem. <br />It might also be helpful to refer in III.B, to the existing contract by which Orono provides police <br />prot^on to Long Lake. Otherwise, it might be possible to construe this agreement as creating a <br />duty on Orono's part to continue enforcing the lake regulations even if the general contract <br />between Orono and Long Lake for police services were terminated. <br />I hope this is helpful.
