A RESOLUTION VACATING AN UNUSED PORTION OF FOREST BOULEVARD WITHIN THE PLAT OF SAGA HILL REVISED, SECTION 7, TOWNSHIP 117, RANGE 23, IN THE CITY OF ORONO, HENNTIPIN COUNTY, MINNESOTA FILE NO. 1298 WTIEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, Richard J. Johnson and Katherine A. Johnson, husband and wife, of 1304 Elmwood Avenue, filed a petition with the City of Orono requesting the vacation of a portion of Forest Boulevard originally dedicated in the plat of Saga Hill Revised legally described as follows: That part of vacated Forest Boulevard as dedicated in the plat of "Saga Hill Revised, Hennepin Co. Minn." which lies between the extensions across it of the northerly line of Lot 1, Block 6, "Saga Hill Revised, Hennepin Co., Minn." and the northwesterly extension of the southwesterly line of Lot 2, said Block 6; and WHEREAS, after due published and posted notice, public hearings were held before the Citv ’s Planning Commission on June 20, 1988, March 15, 1993 and April regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission recommended approval of the requested vacation and the City Council of the City of Orono fm^ that said vacation as proposed, is in keeping with the public interest and in consideration of the following findings: 1.The vacation does not affect the access or the use of adjoining properties. The City has not and does not intend to develop, improve, or use the dedicated right-of-way of Forest Boulevard for road purposes nor any other public purpose. 3.The City has not and does not intend to maintain or install utilities within the dedicated right-of-way of Forest Boulevard.
