A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22, SUBDIVISIONS 1 (A), 1 (B) AND 2 <br />FILE #1979 <br />WHEREAS, Richard L. Little and Deloris A. Little, husband and wife, <br />(hereinafter "the applicants") are owners of the property located at 1890 Shady wood Road within <br />the City of Orono (hereinafter "City") and legally described as follows: <br />Lots 29 and 30, Shadywood, Hennepin County, Minnesota (hereinafter "the property"); <br />and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.22, Subdivisions 1 (A), 1 (B) and 2 to permit the reconstruction of a <br />14’x26 ’ deck to the lakeside of the existing residence to be located 71’ from the shoreline where <br />a 75’ setback is required resulting in 40 s.f. of new hardcover within the 0-75 ’ setback area <br />where no hardcover is allowed and where 227 s.f. or 2.02% exists, 324 s.f. of new hardcover <br />within the 75-250 ’ setback or 29.05% total hardcover is proposed and where 25% is allowed and <br />a further 14’ encroachment of the average lakeshore setback line by the entire 14’x26 ’ deck. <br />Minnesota: <br />1. <br />2. <br />3. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #1979. <br />The property is located in the LR-IC Zoning District requiring 21,780 s.f. or 1/2 <br />acre in area. The property consists of 38,233 s.f. or .87 acre. <br />The Orono Planning Commission reviewed this application on November 21, <br />1994 and March 20, 1995, and recommended unanimous approval of the <br />proposed variances based upon the following unique findings and hardships: <br />Page 1 of 5
