A. <br />B <br />The original residence structure was constructed in the early 50s prior to <br />the current lakeshore development standards. <br />The irregular or cur\’ed shoreline at this property results in an irregular <br />lakeshore setback line. <br />C. <br />E. <br />As the grade level lakeside deck is located completely in front of the <br />residence, the deck will have no impact on the lakeshore views of the <br />residences on either side of this property. <br />The City has received no negative comments from the neighbors on the <br />adjacent properties. <br />The proposed improvement will result in a decrease of 175 s.f. of <br />hardcover improvements within the 0-75’ setback area. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (A), 1 (B) and 2 to <br />permit the reconstruction of a 14’x26 ’ deck granting an average lakeshore setback for the entire <br />structure, a 4’ or 5.3% lakeshore setback variance and hardcover variances within the 0-75’ <br />setback area at 52 s.f. or 0.40% and 1,095.3 s.f. or 4% in the 75-250’ setback area, subject <br />to the following conditions: <br />Page 2 of 5
