A RESOLUTION VACATING <br />A DRAINAGE AND UTILITY EASEMENT <br />WITHIN LOT 2, BLOCK 1 OF THE PLAT OF <br />FOXWOOD SECONT ADDITION, IN THE CITY OF ORONO, <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 1990 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on December 22, 1994, Robert W. Carlson filed a i^tition with the <br />City of Orono requesting the vacation of a 35’ drainage and utility easement originally dedicated <br />in the plat of Foxwood Second Addition and legally described as follows: <br />a 35* drainage and utility easement as shown on Lot 2, Block 1, Foxwood Second <br />Addition, Hennepin County, Minnesota; and <br />WHEREAS, after due published and posted notice, public hearings were held <br />before the City’s Planning Commission on January 17, 1995 and February 22, 1995, regarding <br />said vacation and all interested persons were given an oppormnity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the proposed vacation; and <br />WHEREAS, the City Council of the City of Orono finds that said vacation as <br />proposed is in keeping with the public interest and in consideration of the following findings: <br />1. <br />2. <br />Neither the City nor the MWCC intends to develop a municipal sewer line within <br />the 35’ easement. <br />Location of the easement within the proposed building envelope of the <br />undeveloped lot will present problems with the future residential development of <br />the site. <br />3. The drainage and utility easement as it exists serves no public purposes. <br />Page 1 of 2
