The <br />Release Agreement has been filed by the Fredrikson and Byron law firm against the Chain of <br />Title of the property. There is no public interest served by the existence of the easement. Staff <br />recommends that the 35 ’ drainage and utility easement be vacated and that easements be retained <br />as shown on the staff sketch. Exhibit G. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the proposed vacation <br />subject to the following conditions: <br />1.Applicant to execute drainage and utility easements to ensure 10’ wide easement <br />exists at the north and south lot lines of Lot 2, Block I, Foxwood Second <br />Addition. <br />Execution of a drainage easement to be taken over the portion of the wetland <br />located within the area of the vacated 35 ’ utility easement. <br />The enclosed approval resolution has been drafted per the Planning Commission <br />recommendation. <br />COUNCIL ACTION REQUESTED: <br />To either adopt or amend the enclosed approval resolution.
