Conversion of Use or Slip Size, Effective October <br />29r 1904, no facilities or parts thereof may be converted from <br />any classification of use described in subdivision 1 to any other <br />classification without first securing a new license therefor <br />pursuant to Section 2.03 and, if required, a special density <br />license pursuant to Section 2.05. <br />From and after February 28, 1987, no facility requiring a <br />license under Section 2.03 shall be altered, reconstructed or <br />reconfigured to increase slip size without first securing a new <br />license therefor pursuant to Section 2.03 and, if required, a <br />special density license pursuant to Section 2.05. The facilities <br />and the use of such facilities shall not be nonconforming within <br />the meaning of Section 2.10 or any other provision of the Code <br />granting rights to continue facilities lawfully in existence or <br />licensed as of the effective date of any ordinance, but shall be <br />required to comply with all requirements of the Code as though <br />the facilities were new and not previously existing or licensed. <br />Subd. 4. Change in Rental Policy as Conversion of Use. Any <br />change in rental policy of a Commercial Marina or Private Club <br />which limits or restricts the rental of any slips, moorings or <br />other boat or watercraft storage capacity to owners or groups of <br />owners of specified real property is a conversion of use within <br />the meaning of this Section. <br />J <br />Subd. 5. Annual License Restrictions. In the case of any <br />Commercial Marina Facilities or Private Club Facilities which are <br />located at riparian property which is owned, operated or <br />controlled in whole or in part by owners of specified real <br />property, the Board may require additional information and, <br />following a public hearing, may impose conditions and <br />restrictions at the time of the annual renewal of the license <br />required by Section 2.03 to ensure that no conversion of use <br />within the meaning of this section occurs and that boat rental <br />rights are freely available to the general public with no <br />priority, preference or advantage to owners of specified real <br />Drooerty. If at any time the Board determines that for two or <br />more consecutive boating seasons a majority of the slip spaces at <br />any such facility have been rented, sold or otherwise made <br />available to owners of specified real property, the Board may <br />impose such conditions as it deems necessary or f <br />a public hearing, to ensure that the <br />available to the general public. Such conditions may include, <br />but are not limited to; changes in rental ^ <br />including a required selection of all or some tenants the <br />addition of readily available oF^^L^^futies such al <br />enhancing convenience of access; addition o . services <br />restrooms or pump out facilities; and the <br />such as motor repair, emergency towing, gasoline sales, . ^ <br />and retrieval of boats, or sale of equipment and supplies. <br />Failure or refusal to comply with such conditions shall be deemed <br />a conversion of use within the meaning o i
