) <br />J <br />(Rev.8-91) <br />If at any time an outlot association, as that term is <br />defined in Section 2.11, Subd. 2 e), acquires an ownership <br />interest in riparian property at which a Commercial Marina <br />Facility is located, the Board may impose on the license of such <br />facility any conditions deemed necessary to assure that all <br />previously existing amenities of the types listed in Section <br />2.05, Subd. 4b, whether or not previously required pursuant to <br />Section 2.C5, remain available and to assure that boat storage <br />space remains freely available to members of the general public <br />with no priority preference or advantage to owners of specified <br />real property. <br />Section 2.12. Miscellaneous Provisions. <br />Subd. 1. Use o': Structures for Storage. Unless otherwise <br />specifically permitted by this Code, no structure may be used for <br />the storage of any materials or items other than watercraft. <br />However, throw-out life preservers and fire extinguishers may be <br />stored on multiple docks and mooring areas and commercial docks <br />provided such equipment is properly stored in an orderly manner <br />on racks provided for that purpose. <br />Subd. 2. Prohibited Structures. The following may not be <br />erected on the uake: <br />a) boat houses; <br />decks as defined in Section 1.02; <br />c) roofs; and <br />d) any structure above the horizontal plane of a dock <br />except boat slips and slip structures and service consoles as <br />regulated by this Code. <br />A deck or roof lawfully in existence on May 5, 1977, may <br />continue in existence but may not be structurally altered or <br />expanded in any way. <br />Subd. 3. Boat Slips and Slip Structures. Boat slips or <br />slip structures may be erected in the Lake. Such structures may <br />be of no greater height, area, volume or mass than is necessary <br />to secure and orotect the number of watercraft which it is <br />designed to shelter. The structure shall be so constructed to <br />permit the use of a fabric canopy in conjunction with necessary <br />poles, rigging and appurtenances necessary to support the canopy. <br />A slip structure must be set back from the side site lines of the <br />site which it fronts by a minimum distance of 20 feet. <br />Subd. 4. Construction Standards. Any structure may be <br />constructed of such materials and in such a manner as the owner <br />determines, provided that they shall be so built and maintained <br />that they do not constitute a hazard to the public using the <br />waters of the Lake.
