J <br />(Rev.8-91) <br />licensed for transient use only or facilities which are Outlet <br />Association Facilities or Multiple Dwelling Facilities. <br />c) "Municipal Facilities" includes those facilities <br />located on or adjacent to land owned by a municipality or <br />political subdivision of the State which are operated, controlled <br />or licensed by the municipality or political subdivision. <br />d) Transient Facilities" includes those facilities or <br />parts of facilities which are licensed for transient use only. <br />e) "Outlot Association Facilities" includes facilities <br />owned or operated by a homeowners association, outlot association <br />or other similar organization whose membership is restricted to, <br />or comprised in major part of, owners of specified real property. <br />Outlot Association Facilities also include any facilities which <br />provide to owners of specified real property any priority, <br />preference, or advantage over the general' public in renting, <br />purchasing, or otherwise securing boat storage rights. In the <br />case of facilities at riparian property which is owned or <br />controlled in whole or in part by an outlot association, any <br />policy or practice which allows the subletting, assignment, or <br />other transfer of dock storage rights from one lessee to another <br />shall be deemed a priority, preference, or advantage for <br />specified real property. <br />Also, in the cases of facilities at riparian property which <br />is owned or controlled in whole or in part by an outlot <br />association, any characteristic of the facility or any policies <br />or practices of the owners or operators which tend to, 1) <br />discourage the general public from renting boat storage space at <br />the facility, or 2) make the facility less desirable to the <br />general public than commercial marinas providing a full range of <br />services and facilities, may be deemed a priority, preference or <br />advantage for specified non-riparian real property if a majority <br />of slips are rented to owners of such property. <br />For purposes of this paragraph, an outlot association <br />includes a homeowners association, condominium association or any <br />similar organization whose membership is restricted to, or <br />comprised in major part of, owners of specified real property. <br />f) "Multiple Dwelling Facilities” includes facilities <br />leased or otherwise made available in conjunction with the <br />leasing of apartments or other dwellings for residential use. <br />g) "Private Multiple Facilities" includes any facilities <br />constructed or maintained at single family residential properties <br />for the private uses of the residents thereof. <br />h) "Other Facilities" includes all facilities requiring a <br />license pursuant to Section 2.03 of the Code which are not <br />described in paragraphs a) through g).
