9 . <br />Request for Council Action continued <br />page 2 of 2 <br />January ?1, 1995 <br />#1987 Larr>' Pillar, 2705 Ethel Avenue <br />The hardships are reviewed as follows: <br />1 The location of 50 year old house on property installed prior to current zoning <br />standards. <br />2 There is no visual impact on adjacent residence that would receive most impact. <br />3. The 14’ unimproved alley provides an additional butfer to the residence to the <br />north receiving most impact. <br />4. The structure provides an internal enclosed access to basement level and the rear <br />of residence. <br />5. If unimproved 14’ alley was vacated, this property would receive benefit of the <br />entire 14’ right-of-way because the alley was dedicated with the platting of the <br />Casco Heights plat in 1911. <br />The Planning Commission unanimously approved a side setback variance as proposed <br />based on the applicant’s hardships as noted. Thev conditioned approval on applicant obtaining <br />a penalty building permit as soon as Council had completed the review of the application. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution drafted per the findings and conditions of the <br />Planning Commission recommendation.
