w \ >
REQUEST FOR COUNCIL ACTION
<
DATE: January 3f,
ITEM NO.= 5
Department Approval:
Name Jeanne A. Mabusth
Title Building & Zoning Administrator
Administrator Reviewed:Agenda Section:
Zoning
Item Description: #1987 Larry Pillar, 2705 Ethel Avenue - Variance - Resolution
Zoning District: LR-IC
Total area of property = 15,000 s.f.
Pertinent Ordinance
Section 10.25. Subdivision 6 (B) - Side yard setback variance.
Required = 10 ’
Existing = 6 ’ (Principal structure located 4.7 ’ from side lot line)
Proposed = 6 ’
Variance = 4 ’ or 40%
Brief Review of Application
For more detail on this review, please refer to the staff memo enclosed dated January 11,
1995 and the minutes of the Planning Commission meeting of January 17, 1995.
The applicant commenced repairs of three season porch without the required building
permit. The applicant advised that he began to make repairs to the foundation and decided to
replace the foundation. With foundation repairs he then proceeded to replace the stud walls and
siding. The current renter advised of a leak in the porch roof and then when inspected for
repair. Pillar decided that it too should be replaced. The applicant estimates that the three
season porch was approximately 50 years old. The structure not only serves as a three season
porch but as the main rear entry to the residence and provides internal access to the basement
level. Because of the existing floor layout and the windows to the immediate south, the addition
could not have been reinstalled the additional 4 ’ to meet the 10 ’ setback from the side lot line.
As already noted, the applicant does not reside at the property and has not for five years.
The construction was begun in the late fall and has been worked on off and on until the Stop
Work Order was issued. The applicant advised that the work was conducted over a series of
weekends and there was no attempt to hide or rush to complete construction.
