Motion, <br />Ayes 3, Nays 1. Brown voted nay. Motion carried. <br />#1233 NICHABL HALLBT BOMBS INC. <br />2715 PBMCB LAMB <br />OOMOITIOBAL 08B PBBNIT ABD PARIABCB <br />ANBBDBD APPLICATIOB - SBCOMD BBVIBH <br />Architect Larry Kollmeyer was present representing <br />Michael Halley Homes for this matter. <br />Jacobs explained the request for a conditional use <br />permit and variance to reconstruct an existing retaining <br />wall within 75' of the lake; and install a drainage pipe <br />within 75’ of the lake. <br />Chairman Kelley read the City Engineer's recommendation <br />of this proposal. <br />It was noted that the proposal includes constructing a <br />walkout basement with a berm between the home and the <br />lake. <br />Bellows felt that they were being asked to solve a <br />problem (through a variance to the ordinance) that is <br />being created by the proposed design. <br />Chairman Kelley asked Mr. Kollmeyer what the hardship <br />was to support granting the variance and conditional use <br />permit for the drainage pipe? <br />Mr. Kollmeyer did not indicate any specific hardship, <br />but questioned why a drainage pipe buried below the <br />surface of the yard would be a problem? <br />Bellows explained that an outlet pipe to the lake is not <br />in the spirit of Orono's protection of disturbing the <br />lakeshore and water quality. She further explained that <br />the proposal is creating an unatural drainage situation, <br />a solution affecting the 0-75' lakeshore yard being <br />created by the desire for a walkout basement. <br />Mr. Kollmeyer felt a 6-10" pipe would have an minimal <br />physical effect to the lakeshore. <br />8
