The house will now be located behind the 0- <br />75* setback line but will still require an average lakeshore <br />setback variance. In the 75-250' zone, hardcover will be <br />increased from 26.5% to 31.9%. Hardcover in the 0-75' zone on <br />the south side of the property will remain at 25.1%; on the north <br />side, 0-75* zone, hardcover will be reduced to zero. <br />Chairzian Kelley questioned the Berrys' proposal for a three- <br />car garage. Mr. Berry clarified that he would be agreeable to <br />add an attached three-car garage and remove the detached garage. <br />Gaffron observed that such a proposal would offer a fairly even <br />trade in hardcover. Kelley expressed his preference for this <br />proposal. Planning Commissioner Cohen concurred, as did Hanson <br />and Moos. Kelley recommended that approval of this application <br />be conditioned upon the removal of the detached garage and <br />straightening the driveway. The Berrys would then be able to <br />build a three-car attached garage. <br />Gaffron explained that only minor grading would be necessary <br />with the revised proposal. This would be accomplished by raising <br />the east end of the house approximately 2'. Grading in the 0-75' <br />zone will be necessary to bring the old basement excavation back <br />to a conforming grade. <br />There were no comments from the public regarding this matter <br />and the public hearing was closed. <br />It was moved by Chairman Kelley, seconded by Planning <br />Commissioner Hanson, to recommend approval of the hardcover <br />variance as proposed: 0-75 (southslde) 25.1%; 0-75 (northsidrj <br />0%; and 75-250 31.9%. The existing garage will be removed and a <br />third stall added to the attached garage. The driveway is to be <br />straightened. It was further recommended that a variance and <br />conditional use permit allowing filling and grading within 75* <br />of Lake Minnetonka be approved for the driveway reconfiguration <br />and grade restoration at the old basement, along with a 2' <br />average lakeshore setback variance. The hardship in this <br />application is that the applicant met the spirit of the revisions <br />requested by the Planning Commission and has reduced the <br />hardcover within the 0-75' zone and the average lakeshore <br />setback.
