Zoning File #2136 <br />May 14, 1996 <br />Page 4 <br />The City will ask for drainage easements over all drainageways and sediment/detention ponds <br />writhin plat. <br />The applicant must begin the permitting process with the Minnehaha Creek Watershed District. <br />Applicant must obtain MC\\T) permit before final plat approval can be granted by City. <br />Wetlands <br />The City will ask for a flowage and conservation easement to be taken over the designated <br />wetland within Lot 6. Applicant shall develop private covenants to ensure protection of the <br />Type 1/2 wetlands located within Lots 1, 3, 4 5 and 6 to be filed in the Chain of Title of each <br />of the lots. The covenant shall include a site plan locating the protected area. The purpose <br />of the covenant is to advise each owner of the need to first seek approval of the Corps of <br />Engineers and the Minnehaha Creek Watershed District for any land alterations proposed within <br />the protected area before coming to the City for approval and permits if necessary. <br />The City will ask for drainage and utility easements along all lot lines, 5' adjacent to internal <br />lot lines and 10* along all e.xtemal lot lines. <br />Septic <br />Please review Exhibit F, Weckman notes Lois 1-5 have suitable soils for both a primary and <br />alternate on-site sewage treatment system. The results of the septic testing confirm that all 12 <br />septic systems are to be designed as mound systems. The only suitable treatment sites within <br />Lot 6 are located to the west and north of the residence. The alternate site is located on an <br />8% slope where the Code would limit slope to 6%. The primary test site will not meet the <br />75' setback from the existing well and will be located 60'. Weckman has opted to grant an <br />administrative variance rather than asking applicant to relocate well. Staff has no problem with <br />granting a slope variance for the alternate system as all 11 other mound sites meet the 6% <br />slope standard. Note both primary and alternate systems will meet the 75' setback from the <br />designated wetland which Weckman has confirmed in his recent site inspection. <br />Access/Privatc Road/Maintenance Covenants <br />Review Exhibits G, H-1-2 and J, the two new curb cuts at North Shore Drive have been <br />approved by the County as shown on the approved access plan. As in the review of an earlier <br />subdivision, the County once again asks for 17' of additional right-of-way for North Shore <br />Drive and 7' for Bayside Road or County Road 84. The City agreed to the granting of 17' <br />along the North Shore Drive but denied the request for 7' along Bayside Road. In the current <br />review, the County now asks for a 10’ bike trail easement in addition to the 17' of additional <br />right-of-way. Review Exhibit K, the County was asked to consider the impact upon the septic <br />sites of Lots 5 and 6 with the granting of additional right-of-way. The County asks for only <br />T of additional right-of-way and 6' for bike trail easement.
