Previous variances were granted in 1995 for hardcover in the 0'-75' setback. Stc Exhibit J , <br />Resolution #2072. The applicant is not requesting variances to install additional hardcover. <br />STATEMENT OF HARDSHIP <br />The applicant has provided a statement in Exhibit C. <br />Criteria for Determining Undue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />There is an existing residence on the property and a guest house. The applicant will <br />need fo provide testimony as to the reasonable use of the existing structure. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The plight of the landowner is created by the shape of the lot, the zoning lot's location <br />on a peninsula, the topography and mature trees and the desire to construct a new <br />residence at the proposed residence. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The zoning lot will remain residential, however, this structure is larger than the existing <br />structuie when viewed from the lakeshore. <br />4.Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />5.\ ’r.due hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for soiai energy systems. <br />Solar access is not a consideration. <br />6.The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />U2265 Robert Lundfor Newmam <br />1655 Bohns Point Road <br />Variances <br />PC: 7/19/97 <br />page-3 <br />J <br />i
