The variance for height will not change the character of the area. <br />5. <br />6. <br />7. <br />8 <br />Econonuc considerations alone shall not constitute an undue hardship if reasonable use for <br />the property exists under the terms of this chapter. <br />Orignally, economic considerauons were one factor because the applicant wanted to use the <br />structure to store vehicles and equipment for his business. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of >^peals and Adjustments or the Council may not permit as a variance for any <br />use that is not permitted under this Chapter for the property in the zone where the affected <br />person's land is located. <br />The Zoning Code does not allow for an oversize structure on the zoning lot to exceed 1,000 <br />sq. ft. on lots less than 2 acre in size. Additionally, the height of the accessory structure <br />cannot be greater than the height of the principal structure or 30', whichever is less. The <br />height would be limited to I r6". <br />The Board or Council may permit as a variance the temporary use of a one-family dwelling <br />as a two-family dwelling. <br />Not applicable. <br />The special conditions applying to the structure of land in question are peculiar to such <br />property or immediately adjoining property. <br />There are special conditions that regulate the height of the accessory structure due to the <br />height of the principal structure. <br />The conditions do not apply generally to other land or structures in the district in which said <br />land is located. <br />The variance being requested is specific to the existing height of the residence on the lot and <br />its architectural style. <br />The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />*3233 WaberHoiztr <br />1130 North Shoro Drive H^est <br />6/16/97 <br />Page^ <br />\
