However, staff has <br />estimated that the existing principal structure is entirely within the 1,000' setback area. The <br />proposed accessory structure is not located within the 1,000' setback area. No hardcover variance <br />is required. <br />STATEMENT OF HARDSHIP <br />The applicant has indicated that the zoning code restricts the allowed height of the accessory <br />structure because of the height of the principal structure. The principal structure is 11 ft. 6 in. in <br />height. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />Any accessory building would have to be less than the height (>11'6") of the principal <br />structure. The residence can continue to be used for residential purposes. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. The landowner is restricted by: <br />1. The height of the principal structure. (11 '6") <br />2. The size of the proposed structure exceeds the size requirements for the lot. <br />(1,200 sq. ft. vs. 1,000 sq. ft.) <br />3.The variance, if granted, will not alter the essential character of the locality.
