Request for Council Action continued <br />Page 3 <br />August 22, 1996 <br />Zoning File # 2158 John O’Sullivan/Former Grace Baptist Church. 2380 Shadywood Road <br />Staff Recommendation <br />As a matter of policy and in deference to past Council indications that re^oning in Navarre <br />should only occur after a comprehensive review of Navarre zoning, stafl' recommended to <br />Planning Commission that a comprehensive study would be appropriate. However, the City <br />also is obligated to respond to this individual property owner's formal request for rezoning in <br />a timely manner. <br />The proposed rezoning likely cannot be considered a "spot zoning", since it proposes <br />commercial use adjacent to other commercial uses, and generally is in keeping with the <br />Comprehensive Plan. The Comprehensive Plan appears to generally support commercial use <br />in and adjacent to the e.xisting Navarre commercial area. See also Exhibit H regarding "spot <br />zoning". <br />Approval of a rezoning requires a two-thirds vote of all the members of the Council. This <br />therefore requires that at least four of the five Councilmembers vote in favor in order for the <br />rezoning to occur. <br />An ordinance has been drafted to accomplish the proposed rezoning, and is attached for Council <br />adoption should Council choose to do so. <br />Options for Action <br />1. Adopt attached ordinance to approve rezoning from LR-IC to B-5. <br />2. Conceptual denial, directing staff to draft a resolution for denial if Council feels a <br />resolution is warranted. <br />3. Table (specify reasons) <br />4.Other. <br />Additionally, Council may wish to direct staff to proceed with an amendment of the B-5 zoning <br />district standards. <br />COUNCIL ACTION REQUESTED: <br />Take action regarding the proposed rezoning.
