Request for Council Action continued <br />c Tage 2 <br />August 22. 1996 <br />Zoning File #2158 John O'Sullivan/Former Grace Baptist Church, 2380 Shadywood Road <br />Planning Commission Recommendation <br />Planning Commission N oted 6 to 0 to recommend approval of the proposed rezoning from LR- <br />IC to B-5. Planning Commission further recommended that the Council direct staff to proceed <br />with an amendment of the B-5 district standards, to eliminate "home and garden equipment <br />rental", "kennels" and "off-slreet parking" from the list of allowed conditional uses in Section <br />10.44, Subd. 4 (A & B), and "tobacco shops" from the list of permitted uses in Section 10.44, <br />Subd. 3. <br />Planning Commission members made a number of specific co mments which provide some basis <br />for their conclusion: <br />While a comprehensi\e review of zoning needs for Navarre would be <br />appropriate, this specific property has been "in distress" for a number of years. <br />If any other property but this one were being proposed for rezoning. Planning <br />Commission would likely be recommending that approval be withheld until a <br />comprehensive study of the area is completed. <br />The B-5 district appears to be the correct fit for the applicant's proposed uses. <br />There appears to be overwhelming support for this rezoning from both the <br />Navarre business community as well as the Navarre residential community. <br />The proposed development will hopefully act as a catalyst for additional <br />redevelopment in Navarre. <br />Certain permitted and conditional uses allowed in the B-5 zone might not be <br />appropriate for this property given its location between commercial and <br />residential, and those uses should be eliminated from the B-5 district as long as <br />that doesn't impact existing businesses in other B-5 districts. These uses include <br />"kennels", "home and garden equipment rental", "off-street parking" and "tobacco <br />shops" as a minimum. <br />Please also review the draft minutes of the August 19 meeting (Exhibit B). Additionally, a <br />number of public comments were received at the public hearing, generaly in support of the <br />proposal (see Minutes). Applicant has also provided copies of the petitions which many area <br />residents have signed in support of the rezoning. <br />L ____
