LINDQUIST SlVE.nNUM P.L.LP. <br />Orono City Council <br />August 8, 1996 <br />Page 4 <br />driveway had been unilaterally abrogated by Tibbels, the then landowner, who simply <br />paved the driveway - to your disgust. <br />Against this backdrop, the Albrechts move in with their young family and attempt <br />to improve the premises. Even though your memories of these past actions cannot be <br />wiped clean, in fairness to the Albrechts, I would like you to concentrate on them as <br />human beings trying to live in their new house and raise their family in the City of Orono, <br />despite all the baggage which goes with their house. I propose to you that 'but for' the <br />history of this site, the request to reduce the hardcover in the 75'-250 ’ zone would be <br />cheered by the Orono City Council as a new homeowner bringing his property more into <br />compliance with Orono City ordinances by the 205 square foot hardcover reduction. The <br />City Council knows that the variance request is a mere technicality in this instance only <br />because not even a rearranging of hardcover is permitted without City approval when the <br />lot is over the limit. <br />A secondary question is, however, present which is potentially decisive. The <br />secondary question is whether the rearranging of the hardcover is a guise or subterfuge for <br />the creation of some other bad or inappropriate condition on the property which should <br />be vetoed by the City Council. In this case, the hardcover reduction is 115 square feet in <br />a landscape area - which can only be positive. The other hardcover reduction is the <br />reduction in size of the driveway and parking area by 255 square feet.
