They <br />bought their house from Mr, Tibbets. They had no special knowledge of Orono's rules or <br />procedures. They did not know the history of this house and lot with Orono. They did <br />not know the lot had a hardcover overage. <br />Rob Albrecht is in the music business. Tara Albrecht was formerly in the music <br />business also, but is now a full-time mother with two young children, ages 4 years and 2 <br />months. Rob Albrecht, being in the music business, and not the construction business. <br />was not familiar with the line between when a building permit was necessary and when it <br />was not necessary. He knows that if you build a house or build an addition to a house, or <br />build a garage, that you need a building permit. He knows that if you plant a new garden. <br />put metal or rubber edging around your lawn or sealcoat your driveway, that you do not <br />need a building permit. He was not aware that you need a building permit for things like <br />construction of a fence, putting up a dock or making a small (165 square foot. <br />approximately 13' x 13') addition to an existing deck. He thought of those activities as <br />falling closer to the landscape-type work than to the house construction work. In his <br />mind, he made an honest mistake. In some of your minds, there is substantial doubt about <br />that fact. <br />But let us assume the worst. Assume that in your mind you are convinced that Rob <br />Albrecht tried to pull a fast one on the City of Orono. What response does Orono have to <br />such action? Orono's land use ordinance provides the penalty of double fees, stoppage of <br />EB01;8S8.175 I
