Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd 6 E 1(c) as follows <br />(c)System Failure Non-Conforming systems Non-Compliant <br />systems discharging pollutants shall have the sewage tanks regularly pumped to limit or eliminate <br />effluent discharge until satisfactory repairs have been completed <br />Section 19. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd. 7 B 3 as follows <br />3 Outhouses shall be constructed in accordance with MPCA Regulations <br />Chapter 7080 0210 Subp 4 , except that sealed vault type outhouses shall not be permitted. <br />Section 20. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd 7 B 5 as follows <br />5 Existing outhouses not conforming to any or all of the above requirements <br />shall be abandoned, filled-in and the superstructure removed within 1 year of notification that a nen- <br />conformity non-compliance exists, but in any ca se not later than 2 years aft er the effcetiv e date of <br />this subdivis ion <br />Section 21. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd 7 D 4 as follows <br />4 Any existing dwelling, building, or structure required by one or more of the <br />above items to be connected to an on-siie sewage treatment system, but which is not so connected <br />as of the eficctive date of this Subdivision, or which has an existing system that does not conform <br />to minimum setbacks or other requirements of the "RS" zoning district, shall have a new conformi ng <br />on -site sewage treatm ent system compliant on-site sewage treatment system installed within one <br />year of notification that a non -conform ity non-compliance exists, but in an y cas e net lotcf than 2 <br />years after the cflectivc date of this Subdivision <br />Section 22. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12.30 Subd 8 B 4. as follows: <br />4 Owners of Non -Gonform mg Non-Compliant systems shall be issued orders <br />requiring maintenance, repair, alteration , or replacement —Systcms-found to be no n-conform ing shall <br />be brought up to conforming statu s per Subdivision 5 (c) as follows: <br />(a)Systems located within the Shoreland District found to be nen- <br />oonformi ng non-compliant due solely to lack of 3 feet of unsaturated soil or sand between the <br />distribution device and the limiting soil characteristics, shall be repaired, attcfe d or replaced within <br />a reasonable period of time not to extend past December 31 of the second year following the year <br />in which repair orders are issued, the intent being that at least two full construction seasons (May <br />thru November) shall be allowed for the completion of repairs <br />(b)Systems located outside the Shoreland District found to be non- <br />confornM Bg non-compliant because they ar e cither "foiling" or "prohibited" os defined in Subd. 2 <br />ef this section, shall be repaired, altered or rcplaccd-within 90 days of fcasiblc -but' in no ca se latcf
