Section 6. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12.30 Subd 2, Def 10(c) iii as follows <br />iii "Non -Conforming System" "Non-Compliant System" - <br />A prohibited system, a system located within a designated 100-year flood plain, any system which <br />mav or mav not meet all the location, design, or construction standards of the current Citv codes and <br />which is failing for any reason, and any system with less than 3 feet of unsaturated soil or sand <br />between the distribution device and the limiting soil characteristics <br />Section 7. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd 4 D 1 as follows <br />1 "Alternative systems" shall not be permitted e.xcept by variance The permit <br />application must include an explanation why a "standard system" is not feasible, include evidence <br />that the proposed method of treatment w ill be effective, and provide a monitoring plan to confirm <br />that the system is functioning properly <br />Section 8. Chapter 12 of the Municipal Code of Orono is hereby amended by amending Section <br />12 30 Subd 4 F as follow s <br />F Building Permit Applications No building permit shall be issued by <br />the City for any new building which that will be connected to a rrew m on-sitc sewage treatment <br />system until the site evaluation report and an on-site system design specification s as required by the <br />MPCA Regulations Chapter 708 0 and the City Code have has been reviewed and approved bv the <br />City No building permit shall be issued for any construction within a designated drainfield site <br />(within the setback from said drainfield site) until another drainfield site is approved bv the City. <br />Where the construction of additional bedrooms, bathrooms, installation of mechanical equipment. <br />or other factors likely-to -affec-t- mechanical equipment likely to affect the operation of the system <br />can be reasonably anticipated, the installation of a system for such anticipated need shall be required <br />on-site system must be confirmed as beinu of adequate capacity for the anticipated use If <br />expansion or replacement of the on-site system is required, an on-site system design must be <br />approved bv the Citv prior to issuance of the building permit Where construction on an existing <br />building can reasonably be anticipated to increase the sewage output for whatever reason, an <br />alternate site or future expansion area (if available^ must be designated and protected No building <br />permit -sliall be issued unless primary and alternate drainfield sites have been tested and approved <br />No building permit or plumbing permit-^hall be issued by the City for any expansion or-a lteration <br />of a building or use connected to an existing on -site system, until such system has been inspected <br />and certified by the City as being in compliance with this Section —Whenever- the addition of <br />bedrooms or -plumbing-fixturcs, or a change-in the character or intensity of the established use is <br />propo sed, the City may require the review and/or replacement, repair, alteration or expons io n-o f the <br />existing ' system or any port ion thereof - <br />Section 9. Chapter 12 of the N'unicipal Code of Orono is hereby amended by deleting Section <br />12 30 Subd 4 G and replacing it as follows <br />G_ Conditional Use Permit and Zoning V^ariance Applications No conditional <br />use permit or zoninu variance application shall be approved for a property until the existing on-site <br />sewage treatment system has been confirmed as beinu of adequate capacity for the anticipated use
