The city agreed, with the condition that the existing right-of-way through the Valek <br />property to the tax forfeit parcel be maintained on the Valek ’s propert>' but moved trom the <br />middle to the edge of the Valek propeny. (Please see the attached Council meeting minutes <br />rellecting the Council ’s action.) The purpose of maintaining the right-of-way is to ensure access <br />to the tax forfeit propeny as it becomes used for a future park. <br />The current right-of-way width through the Valek propeny is 10 feet. This is the current <br />standard for a bike trail, which would not leave any room for maintenance ot the trail. Staff <br />is recommending the right-of-way be increased to a minimum of 20 feet to provide a workable <br />potential access to the park. <br />The Valek ’s have requested that the 1/2 acre parcel be added to their lot without the condition <br />of maintaining a right-of-way through their propeny. They have indicated that either the <br />existing Garden Lane right-of-way or an easement through the church parking lot to the west <br />could be used for future park access. <br />Garden Lane does not provide a link to the 9 acre tax forfeit parcel except at the far <br />nonhwestem end of the Ume. This is not an acceptable access to the park land especially it i <br />is the only access. If additional land between Garden Lane and the nine acre parcel is acquired <br />for park land this may be a more workable access. However, this has not occurred to this point. <br />Pativ Affeldt. representing the Fairview Church, recently contacted the city to indicate an <br />interest in providing an easement through the church parking lot and the church open space area <br />to the tax forfeit parcel. 1 have asked that a letter clarifying and confirming this interest be <br />provided to the city in time for the February 26 Council meeting. This easement could provide <br />an acceptable access to the park area in which case the Valek right-ot-way may not be nee e .
