REQUEST FOR COUNCIL ACTION <br />Department Approval: <br />Name Ron Moorse <br />Title City Administrator <br />DATE: Jun^}^997 ' <br />ITEM NO.: / ^ <br />Administrator Reviewed:Agenda Section: <br />City Administrator’s Report <br />Item Description: Request for Municipal Sewer Service Outside of the MUSA <br />\\ I <br />When the on-site septic system rules changed to make many systems non-conforming, the City <br />identified ten "hot spot" areas with the greatest incidence of non-conforming and failing systems, <br />along with a lack of alternative septic sites, as potential candidates for mumcipal sewer projects. As <br />the City has moved ahead to plan sewer projects, a significant number of additional property owners, <br />mostly near planned sewer projects, have expressed interest in obtaining municipal sewer service <br />as an alternative to installing new septic systems. Most or all of these properties have alternate <br />septic sites. These property owners want to avoid the major impacts to their properties that would <br />occur if a new septic system was installed. <br />Most of those property owners expressing an interest in sewer service are in the Shoreland Zone, <br />which means that at the time their septic systems were found to be non-conforming they were given <br />a two-year period within which to replace the non-conforming septic systems. For many of these, <br />the two-year period is almost expired. They do not want to install new septic systems if there is a <br />chance of obtaining municipal sewer. <br />There are several issues to be addressed regarding the requests for sewer service. <br />1. Should municipal sewer service be extended to these properties? <br />2. How does the extension of sewer service to 2 acre lots relate to the City's long-term <br />land use plan? <br />3.If these properties are not directly adjacent to a sewer line, how does the City obtain <br />permission from the Metropolitan Council to provide sewer to the properties? This <br />may require a MUSA amendment or a change to the current agreement between the <br />City and Metropolitan Council regarding the provision of sewer to individual lots <br />outside of the MUSA. <br />Should the properties that are non-conforming be given an extension of the two-year <br />time period for the replacement of their septic systems while the City addresses the <br />issues related to the extension of sewer service?
