r <br />3. <br />4. <br />5. <br />6. <br />7. <br />Zoning District and partially within the RR-lB-1 Single Family Rural Residential <br />Subdistrict. <br />Within the RR-IB and RR-lB-1 zoning districts, golf courses are a permitted use via <br />conditional i^e permit, subject to the principal structure being located 100 feet or <br />more from any abutting lot in an 'R' District, and subject to accessory structures being <br />a minimum of 50 ’ from any lot line. The proposed golf course meets these minimum <br />requirements. <br />The Orono Planning Commission reviewed the proposed variances and conditional <br />use permits on February 18,1997, March 17,1997, March 31,1997, and April 21, <br />1997; and on April 21,1997 recommended approval of the variances and CUP by a <br />vote of 6-0. <br />The proposed golf course was subject to a mandatory Environmental Assessment <br />Worksheet (EAW) review process as stipulated by State law, to determine whether <br />an Environmental Impact Statement (EIS) would be required for the project. The City <br />Council on May 21, 1997 declared via Resolution No. 3901 that no EIS would be <br />required. <br />The EAW review process resulted in comments and recommendations regarding <br />course design, course operation, and mitigation of environmental impacts, many of <br />which have been incorporated into the Conditions of this resolution. <br />Approval of the requested variance for construction of an oversize accessory structure <br />is justified by the following hardships and unusual conditions: <br />A.The equipment and supplies for maintenance of a 200-acre golf course <br />require a space significantly in excess of the 3,000 s.f. footprint <br />structure that would normally be allowed on a residential property in <br />the RR-IB or RR-lB-1 zone. <br />B.The proposed golf coiuse is not a residential use, and the zoning code <br />limitations on accessory building size were intended to apply mainly <br />to the 2-acre single family lot development typical of the RR-IB and <br />Page 2 of 16
