A RESOLUTION GRANTING <br />VARIANCES AND CONDITIONAL USE PERMITS FOR <br />SPRING HILL GOLF CLUB <br />FILE #2209 <br />WHEREAS, the City of Oiono (hereinafter "the City") is a municipal corporation organized <br />and existing under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted zoning regulations for the <br />orderly, economic and safe development of land within the City; and <br />WHEREAS, Spring Hill Golf Club (hereinafter "applicant"), a Minnesota non-profit <br />corporation, has an interest in property located at 700 Spring Hill Road and other adjacent and <br />nearby parcels, legally described in Exhibit A attached and collectively referred to hereinafter as <br />"the property"; and <br />WHEREAS, the applicant has made application to the City for a conditional use permit <br />(CUP) per Municipal Zoning Code Section 10.28 Subd. 3 and 10.29 Subd. 1 to allow operation of <br />a golf course within the RR-IB and RR-lB-1 zoning districts; a variance to Section 10.03, Subd. 9 <br />to allow construction of an individual accessory structure of 10,000 s.f. in footprint area where a <br />maximum individual accessory structure footprint of 3,000 s.f. is allowed, and to allow a combined <br />footprint area of all accessory structures of approximately 12,000 s.f. where only 6,000 s.f. combined <br />total is allowed; a variance to Section 10.55, Subd. 8 to allow filling, grading and excavation within <br />and within 26 feet of City-protected wetlands; a variance to Section 10.56 Subds. 16(1) & (J) to <br />allow intensive vegetation clearing and placement of fill within a bluff impact zone; and a <br />conditional use permit (CUP) per Section 10.03 Subds. 19-21 to allow land alterations involving <br />movement of approximately 350,000 cubic yards of material within the site. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: <br />FINDINGS <br />1 .
