T 1 <br />Request for Council Action continued <br />Page 2 of 2 <br />February 6,1997 <br />Change Order #1 for Willow Drive Improvements <br />property owner’s unwillingness to provide a permanent easement for the trail. The decision to <br />change the design was based on three factors. <br />1. A curb section would enable the trail to be constructed without a permanent easement. <br />2.The curb section would match the section used for the segment of trail adjacent to the <br />Minnich property directly to the south. <br />3.Although the design change would cause additional construction costs, these would be <br />offset by the savings resulting from the elimination of the need to acquire a permanent <br />easement. The cost of a negotiated permanent easement would have been approximately <br />$6,000-7,000. The cost of the easement, including legal fees if the acquisition required <br />condemnation, would have exceeded $10,000. <br />Because the design change was to result in additional construction costs, a change order with the <br />explanation provided above should have been brought to the Council at the earliest possible time. <br />As indicated in the attached letter from Bonestroo the additional cost informs*' m was i-y'.splaced <br />;n Bonestroo's office which caused a very substantial delay in processing th order. <br />Staff have met with Bonestroo staff to reiterate the importance of proper and timely follow <br />through regarding change orders. The city's new Public Services Director/City Engineer will <br />closely monitor all future projects to ensure this process is followed. <br />COUNCIL ACTION REQUESTED: <br />Motion to approve change order for the Willow Drive Municipal State Aid improvements in <br />the amount of $8,940, and to approve change order #1 for the Old Crystal Bay Road Walkway <br />in the amount of $9,614.80 <br />....................
