It is understood that the City is requesting the State, the City and the <br />City of Orono to enter into a binding agreement such that there will be no <br />expansion in the number of through lanes on new TH 12, or existing east/west <br />roadways in Long Lake or to propose a new east/west roadway through Long Lake <br />without the consent of both Orono and Long Lake, The State is willing to enter into <br />an agreement including the City and the City of Orono as stipulated above for a <br />period of twenty (20) years after the year of completion of the TH project and date <br />the new corridor has opened for motorized vehicles. <br />14. The State’s financial obligation referenced in this MOU are subject to <br />and conditioned upon the current availability of funds apportioned by the legislature <br />for these purposes. However, the State will not commence construction of the <br />proposed corridor if it is apparent that funds will not be available for the project, <br />including funding for the elements of the whole project for which the State is <br />responsible, as described in this MOU. ' <br />15. It is understood that the State will continue to meet the requirements of <br />Minnesota Statute section 161.174, et seq . regarding the submission of layout plans <br />and will seek the required approval by the city. <br />16. It is understood that agreements between the City and the State will be <br />necessary to fully resolve many of the issues addressed in this MOU. For example.
