The structure also cannot be used as a home occupation because it <br />is proposed to be separate from the principal structure. <br />The special conditions applying to the structure or land in question are peculiar <br />to such property or immediately adjoining property. <br />Many of the zoning lots in this area do not meet the minimum lot area or lot width <br />requirements. This lot has excessive hardcover in the 75-250'setback area because <br />of the driveway. New construction is limited by the lot width and wetland setback <br />requirements. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />8. <br />9. <br />The zoning district standards apply to all other lots in this district. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The applicant shall provide the Planning Commission with testimony to the <br />necessity of having a hobby room and protecting his propert}' rights. <br />The granting of such variance will not merely ser\ e as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difTiculty. <br />The variance would be a convenience to the applicant if approved as proposed. The <br />hobby room could be relocated on the site and the driveway reconfigured to more closely <br />meet the intent of the Zoning Code regarding hardcover. <br />Issues <br />1. <br />2. <br />The lot does not meet lot area or lot width requirements. The residence encroaches into <br />the required side setback and the average lakeshore setback. The swimming pool and deck <br />also encroach into the required lakeshore setback. <br />The amount of hardcover in the 0 ’-75' setback and 75‘-250' setback already exceeds the <br />maximum amounts allowed. <br />3.There is a wetland on the subject property that restricts the location of a hobby room to <br />be located in the 250-500' setback area.
