STATEMENT OF HARDSHIP <br />The subject property is substandard for lot area and lot width. The principal structure encroaches <br />into the required side setback from the west property line and also encroaches into the required <br />average lakeshore setback. The swimming pool encroaches into the 75' lakeshore setback. The <br />property exceeds the minimum hardcover requirements in two setback areas. There is a wetland on <br />the property which limits the possible areas for new construction. <br />Criteria for Determining Undue Hardship <br />1. The property in question caimot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property can continue to be used as a residence. The hobby room would be an <br />additional amenity for the property owners. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The situation is created by the owner's desire to have a 750 sq.ft, hobby room and the <br />substandard characteristics of the lot respective to the zoning district's minimum <br />requirements. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The hardcover variance will locate a new structure 10'from the east property line, 23'from <br />the adjacent residence. The side setbacks for principal structures in this district is 30'. <br />4.Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />The applicant has not indicated that there is any economic reason to locate the structure <br />on the subject property. <br />5.The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person’s land is located. <br />A hobby room as an accessory structure is allowed in this zoning district.
