4.The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Residences are allowed in this zoning district. All new residences are to be located at <br />least 30' from the top of the bluff. <br />5.The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />'\djacent properties are also located along the bluff line. From the topographical map it <br />appears that this lot is most restricted by the bluff line and the location of the residence <br />in relation to the roadway. <br />6.The greinting of the application is neces; ary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The applicants have provided a letter indicating what their hardship is regarding their <br />property. They will need to provide testimony regarding why the screen porch is <br />needed to preserve and enjoy their interest in the property. A variance to allow the <br />existing deck to be replaced meets this requirement as it is existing. <br />7.The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />No replacement or additions can be constructed without a bluff variance. <br />Issues <br />1. <br />2. <br />This lot meets the setback requirements for street yard, side yard and lakeshore setback. <br />The topographical map and survey indicate that the existing residence is located over <br />the top of the bluff. <br />3. <br />4. <br />The applicant is proposing replacement of an existing deck that is in poor condition. <br />The proposed screen porch is 18' x 22' and would be constructed on pylons.
