MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, August 10, 2015 <br />7:00 o'clock pm. <br />8. #15-3753 CITY OF ORONO PARK COMMISSION, VARIANCE (continued) <br />Barnhart stated to his understanding they are attempting to keep people from wandering into the channel. <br />Levang stated her understanding is it is a safety issue. <br />Morin stated someone was actually on the channel wall fishing and broke the channel wall on his <br />property. The police were called regarding that incident. Morin indicated he has approximately 100 <br />pictures of guys fishing on his property and that it happens every weekend and every night. <br />Morin pointed out the location of the wood wall where people fish from. Morin stated they also go up on <br />his dock. <br />Levang stated that could be very dangerous. <br />Morin stated one guy actually did fall and ended up in the water after a portion of the wall broke. Morin <br />stated something needs to be done with that wall. Morin stated he did speak with the City about it and he <br />was told that the wall is his but it kind of is not his. <br />Tanya Srepfel stated the key question is whether they own the wall or whether the city or homeowners <br />association owns it. <br />McMillan stated the fence is for the people who come down and use the beach. <br />Levang stated the area perhaps should be signed no fishing or no trespassing. <br />Charles stated the fence should go all the way to the wetland, but that people will still likely try to access <br />that wall. Charles stated he would like the name of someone to call because numerous phone calls have <br />been made for someone to look at the wall and fix it. <br />Srepel indicated she has talked to the LMCD and they told her to talk to the City. <br />Mattick stated he is not sure the wall is city property. <br />Gaffron asked if there is a 3 -foot strip that goes all the way down. <br />Morin stated there is. <br />Gaffron stated the assumption is that when the lagoon got created, which was not by the City, they made a <br />whole new channel. Gaffron stated it is likely the homeowner owns the wall and that it would be their <br />responsibility to replace it or repair it. <br />Walsh noted the fence being proposed is a split rail fence, which will not keep anybody out. <br />McMillan stated the City may want to survey the beach. <br />Page 21 of 32 <br />
