MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, August 10, 2015 7:00 o'clock pm. 8. #15-3753 CITY OF ORONO PARK COMMISSION, VARIANCE (continued) Barnhart stated to his understanding they are attempting to keep people from wandering into the channel. Levang stated her understanding is it is a safety issue. Morin stated someone was actually on the channel wall fishing and broke the channel wall on his property. The police were called regarding that incident. Morin indicated he has approximately 100 pictures of guys fishing on his property and that it happens every weekend and every night. Morin pointed out the location of the wood wall where people fish from. Morin stated they also go up on his dock. Levang stated that could be very dangerous. Morin stated one guy actually did fall and ended up in the water after a portion of the wall broke. Morin stated something needs to be done with that wall. Morin stated he did speak with the City about it and he was told that the wall is his but it kind of is not his. Tanya Srepfel stated the key question is whether they own the wall or whether the city or homeowners association owns it. McMillan stated the fence is for the people who come down and use the beach. Levang stated the area perhaps should be signed no fishing or no trespassing. Charles stated the fence should go all the way to the wetland, but that people will still likely try to access that wall. Charles stated he would like the name of someone to call because numerous phone calls have been made for someone to look at the wall and fix it. Srepel indicated she has talked to the LMCD and they told her to talk to the City. Mattick stated he is not sure the wall is city property. Gaffron asked if there is a 3 -foot strip that goes all the way down. Morin stated there is. Gaffron stated the assumption is that when the lagoon got created, which was not by the City, they made a whole new channel. Gaffron stated it is likely the homeowner owns the wall and that it would be their responsibility to replace it or repair it. Walsh noted the fence being proposed is a split rail fence, which will not keep anybody out. McMillan stated the City may want to survey the beach. Page 21 of 32
