)AD <br />MIMJTES OF A PLANNING COMMISSION MEETING HELD SEPTEMBER 20, 1976 - PAGE 5The Zoning Administrator explained to the Comnission that <br />this item was not on the agenda. The Mayor had set up a <br />m^t^ earlier today at the Village Office with Mrs. <br />William IVyatt. The Mayor requested that this subdivision <br />(final) proposal be brought before the Planning Comnission <br />tonight for a recoimendation to Council. The Zoning <br />Administrator stated that this is not a legal plat and does <br />not meet final requirements. The plat submitted by the <br />IVyatt's was a copy of the preliminary plat. Therefore, the <br />signature of the surveyor was also a copy. Plat does not <br />have the necessary property description and space for signa <br />tures. The proposal (k>es not meet the stbdivision exceptions <br />as a variaiKe would be required for the lot that does not <br />meet the minimum zoning area requirement (39.021). Hank <br />Mjhiw also infoimed the Commission that the surveyor, <br />Arleigh C. Smith, had voluntarily surrendered his <br />Certificate of Registration to practice Land Surveying <br />rather than face charges of incompetency. <br />The V\^tt’s were present and were very persistent in express <br />ing their feelings that the plat submitted was satisfactory. <br />After much discussion. Van Nest moved. Hake seconded, to deny <br />ttie final plat on the basis that it does not comply with Section <br />39.400 and does not meet the requirements for Exception, Section <br />39.021 • The Planning Commission requested that the final plat <br />TO redone and submittedin compliance with Section 39.400 as <br />interpreted by our legal staff and Zoning Administrator. <br />Motion - Ayes (8), Nays (0). <br />The Wyatt's were advised to make the necessary changes to <br />meet the requirements and to bring the plat back to the <br />Commission. <br />ROBERT WATT <br />4220 mTERTOW ROAD <br />SUBDIVISION (FINAL) <br />^e Comnission reviewed this matter and after some discussion <br />Pesek moved, Guthrie seconded, to reccninend not to extend the <br />moratorium, but instead enforce the 200' dock length as <br />established by the liCD. Motion - Ayes (8), Nays (0). <br />The Planning Comnission appointed a comnittee on the <br />Platting Ordinance. Paul Pesek was named Chairman and <br />will have assistance from George Hosfield and John Hake. <br />UvICD DOCK REGULATIONS <br />AND POLICIES <br />PLATTING ORDINANCE <br />NARY) <br />BLVD. <br />The Planning Commission expressed their surprise and concern <br />to ^e Zoning Adm^istrator concerning Council's reversal of <br />uieir recommendation on the Klaus Becker subdivision. The <br />Plan^g Comnission had recommended denial of the proposed <br />sub^vision of 5 lots. They offered Mr. Becker the oppor <br />tunity to submit a revised proposal of only 4 lots, or the <br />^ssibility of a^uiring enough additional land for the 5 <br />lots to meet minimum area requirements. A reason for their <br />concern of Council's decision was this item was listed as a <br />progress report on the j^enda for the Council meeting of <br />Septencer 13.
