MINUTES OF A PLANNING COfUSSIC^I MEETING HELD AUGUST 16, 1976 - PAGE 2 <br />!. <br />Robert Niichel and his attomey, Bob Ntary, were present at <br />the meeting. They explained that no other property was <br />available to relocate the access point. Mr. Niichel also <br />stated that a cliange in the access would destroy his <br />original plan. They recognized the concern of the County, <br />and hoped that the County would understand their situation. <br />After all the public were heard, the public hearing was <br />closed at 8:20 p.m. <br />ROBERT NIICHEL <br />3175 SIXTH AVENUE N. <br />(continued) <br />I P.M. <br />mo <br />P.M. <br />ARY) <br />The Acting Chaiiman announced that this was the time and <br />place for a Public Hearing on the petition of William IVear <br />for a Conditional Use Permit (Service Station) for property <br />located at 2260 Wayzata Boulevard. The Zoning Administrator <br />presented the Notice of Public Hearing and the Affadavit of <br />Publication. <br />Mr. Wear was present and explained that the service station <br />would be in the frcHit of the building. This would be self- <br />service with the customers pa>ing inside the mini mart. <br />Mr. Todd Fruen, a property owner to the west of this appli <br />cation, informed the Conmission that a restrictive covenant <br />had beei. set up by the property owners. Mr. Fruen stated <br />that he was not opposed to the mini mart; however, he did <br />feel that there was no need for this 24-hour service as it <br />would only be a nuisance. The Zoning Administrator <br />infoimed the Planning Conmission that we were not involved <br />with restrictive covenants and could address only through <br />zoning. Mr. Wear then stated that the restrictions had <br />been removed from the deed. Member McDonald was concerned <br />about the amount of traffic involved with this service <br />station. Mr. Michael, attomey for Mr. Ifear, stated that <br />he felt they would be catering to the traveling public <br />which would generate the same kind of traffic as the mini <br />mart. After all the public were heard, the public hearing <br />was continued until the next Planning Canmission meeting. <br />Acting Chairman Hannah called to order the Regular Meeting <br />of the Orono Planning Conmission. <br />WILLIAM WEAR <br />2260 WAYZATA BOULEVA’d) <br />CONDITIONAL USE PERMIT <br />(SERVICE STATION) <br />CALL TO ORDER - 8:30 P.M. <br />REGULAR MEETING <br />Hosfield moved, McDonald seconded, that the minutes of the <br />Planning Conmission meeting of August 2, 1976, be approved. <br />Motion - Ayes (5), Nays (0). <br />APPROVAL OF MINUTES <br />MEETING AUGUST 2, 1976 <br />The Planning Commission proceeded to discuss the subdivision <br />application of Gerald Parten. Member McDonald was concerned <br />about drainage at the existing road. The Parten's informed <br />bfejnber McDonald and the Conmission that there is now a <br />culvert under the gravel road. Hake moved, Hosfield <br />seconded, to reconmend approval of this subdivision subject <br />to a park dedication fee and final plat to be submitted, <br />and on the condition that the County approve of any new <br />access to the north parcel.
