A RESOLUTION RELEASING LOTS 1 THROUGH 8, <br />CRYSTAL BAY PRESERVE FROM RESOLUTION <br />NO. 1757 <br />- FILE NO. 2518 <br />WHEREAS, George W. Stickney (hereinafter the "subdivider") has requested a <br />Conditional Use Permit, approved on May 13, 1985 be released within the plat of Crystal Bay <br />Preserve; and <br />WHEREAS, on August 23,1999, the City Council approved the plat of Crystal Bay <br />Preserve; and <br />WHEREAS, the plat of Crystal Bay Preserve included property located at 250 <br />Old Crystal Bay Road legally described as follows: <br />That part of Lot 1, Auditor's Subdivision Two Hundred twenty-nine (229), <br />Hennepin County, Minnesota, according to the plat thereof on file or of record <br />in the office of the Registrar of Titles in and for said county, lying Southerly of <br />a line drawn parallel with and 240 feet Southerly of, as measured at right angles <br />to, the North line of said Lot 1 and lying Westerly of a line drawn parallel with <br />and 1,070 feet Easterly of, as measured at right angles to, the West line of said <br />Lot 1 (hereinafter "the property"); and <br />WHEREAS, at their regular meeting held on December 13, 1999, the Orono City <br />Council releases Lots 1, 2, 3, 4, 5, 6, 7 and 8 from the Conditional Use Permit, per Resolution <br />No. 1757 based on the findings noted below: <br />1.A conditional use permit for a guest apartment was approved by the Orono City <br />Council for property located at 250 Old Cry stal Bay Road. <br />The plat of Crystal Bay Preserve was approved for eight lots, no lots can meet <br />the required area standard for two residential properties. <br />Page 1 of2 <br />J
