• i <br />Surrounding Properties <br />The dock is located south of Bayside Road on Stubbs Bay. There are no residences located <br />immediately adjacent to the dock. The adjacent properties located north of Bayside Road are zoned <br />LR-1A One Family Lakeshore Residential (2 acre minimum lot size). The immediately adjacent lot <br />to the dock site is owned by the property owner to the north side of Bayside Road. The lots shown <br />on the enclosed plat map below the OHWL of Lake Miimetonka remain on record, however all are <br />tax forfeited properties. <br />Issues for Discussion <br />1.The dock is owned and maintained by the City of Orono. It has been provided as a public <br />dock for many years for use by the public. <br />2.Relocating the dock will require filling a small portion of wetland for access to the lake. The <br />amount of fill requires the City issue a Conditional Use Permit. <br />3.The dock is for pedestrian use only, not for boat storage. No overnight parking is allowed <br />along Bayside Road. <br />4.There is no increased impact to adjacent property owners. The dock and walkway will <br />replace what has existed for many years. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the conditional use permit and variance request to relocate an <br />existing dock based on the following: <br />1. The dock has existed as a public structure for many years. <br />2.The dock will be located on public property and continue to serve as a public access <br />to Lake Minnetonka. <br />3.The amount of fill required for the project will not exceed what is necessary to <br />provide adequate public access to the dock. <br />% . <br />f* <br />•** If - V4» »• *: <br />:
