This application requires the following: <br />1. Conditional Use Permit to permit greater than 10 cubic yards of fill within 75’ of the <br />OH WL of Stubbs Bay. <br />2. Variance to allow 180 s.f. (15.0%) of hardcover where no hardcover is allowed. <br />Pertinent Ordinances: <br />Section 10.03, Subdivision 19: Filling of more than 10 cubic yeirds within the shoreland area of <br />Lake Minnetonka requires the City Council grant a conditional use permit. The total fill for the <br />project is 21.11 cubic yards of fill. The fill would create a base to accommodate a walking path to <br />access the dock. The proposed walking path will be consistent with the existing path located on the <br />site. <br />Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1): To permit 180 s.f <br />(15.0%) hardcover within the 75' setback from the (OHWL) where no hardcover is allowed under <br />normal conditions. <br />Hardcover <br />Distance <br />from <br />Shoreline <br />Total Area <br />in Setback <br />Existing <br />Hardcover <br />Allowed <br />Hardcover <br />Proposed <br />Hardcover <br />Variance <br />Requested <br />0’-75 ’1,200 s.f.Os.f.Os.f.180 s.f:To permit a <br />180 s.f. walk <br />path. <br />Permit Request from Minnehaha Creek Watershed District <br />The proposed project requires a permit to be granted by the Minnehaha Creek Watershed District <br />for filling of the wetland. Jim Hafiier, of the Watershed District, has stated the Wetland <br />Coi^ervation Act (WCA) allows filling of wetlands up to 400 cubic feet if the City demonstrates the <br />project has no other alternatives to avoid filling of a wetland and the project minimizes the amount <br />of fill required for the project. Prior to any work within the wetland the Watershed District must <br />issue a permit for the project.
