A RESOLUTION GRANTING VARIANCES PER MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2 AND SECTION 10.56, SUBDIVISION 16 (L) (1) AND A CONDITIONAL USE PERMIT PER SECTION 10.03, SUBDIVISION 19 FILE NO. 2501 WHEREAS, the City of Orono (hereinafter the "applicant") is owner of a public dock and landing located at 3601 Bayside Road within the City of Orono (hereinafter "City"); and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono 2^ning and Planning Codes, the Orono Planning Commission held public hearings on June 21, 1999 and July 19, 1999, at which times aU persons Hpjgiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, the applicant has applied to the City for variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1) to pennit an access trail within the 0-75’ lakeshore setback to provide public access to an existing City dock located on the North end of Stubbs Bay. The trail requires 180 sq. ft. of hardcover in the 0-75’ lakeshore where no hardcover is normally allowed; and WHEREAS, the applicant has tq>plied to the City for a conditional use pennit to Municipal Zoning Code Section 10.03, Subdivision 19 to allow filling of 180 square feet of a non-Orono protected wetland; grading within the 0-75’ lakeshore setback and within 5’ of a property line; and placement of 12 cubic yards of fill material within the 0-75’ lakeshore setback; to permit access to an existing City dock located on the North end of Stubbs Bay. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zomng File ^501. 2.
