A RESOLUTION GRANTING VARIANCES PER <br />MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2 <br />AND SECTION 10.56, SUBDIVISION 16 (L) (1) AND <br />A CONDITIONAL USE PERMIT PER <br />SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 2501 <br />WHEREAS, the City of Orono (hereinafter the "applicant") is owner of a public <br />dock and landing located at 3601 Bayside Road within the City of Orono (hereinafter "City"); <br />and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono 2^ning and Planning Codes, the Orono Planning <br />Commission held public hearings on June 21, 1999 and July 19, 1999, at which times aU persons <br />Hpjgiring to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (1) to pennit <br />an access trail within the 0-75’ lakeshore setback to provide public access to an existing City <br />dock located on the North end of Stubbs Bay. The trail requires 180 sq. ft. of hardcover in the <br />0-75’ lakeshore where no hardcover is normally allowed; and <br />WHEREAS, the applicant has tq>plied to the City for a conditional use pennit to <br />Municipal Zoning Code Section 10.03, Subdivision 19 to allow filling of 180 square feet of a <br />non-Orono protected wetland; grading within the 0-75’ lakeshore setback and within 5’ of a <br />property line; and placement of 12 cubic yards of fill material within the 0-75’ lakeshore <br />setback; to permit access to an existing City dock located on the North end of Stubbs Bay. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zomng File ^501. <br />2.
