#2372 - Haglund - Final Plat Approval <br />June 24, 1999 <br />Page 2 <br />Park Dedication Fee <br />The City Assessor in July 1998 established a valuation for Lot 1 at $64,000, which at 8% would <br />yield a Park Dedication Fee of $5,120. However, this exceeds the maximum allowed park fee. <br />Therefore, the park fee to be charged will be the maximum allowed by ordinance, $4900. <br />North Arm Lane Acquisition <br />At the time of preliminary plat approval in June 1998, Council established that the applicant need <br />merely acquire an easement from the Armstrong's (who are fee owners of the 33' x 854.5' corridor <br />in which North Arm Lane exists) from Lot 1 to the traveled and maintained portion of North Arm <br />Lane. Council subsequently directed staff to pursue the acquisition of the entire 33' North Arm Lane <br />corridor. In April 1999 after some months of discussion, an agreement was reached with the <br />Armstrong family members, as follows: <br />1.The City will agree to pay $2,500 to the Armstrong family and the purchaser of the new <br />Haglund lot, Dave Supprell, will pay an additional $2,500 plus Armstrong's legal fees <br />incurred. <br />2.The City will agree to continue plowing the road all the way to the existing farmhouse <br />without cost to the Armstrongs as it has in the past. <br />i.The City will agree to dedicate (declare) the road as a public roadway. North Arm Lane will <br />continue to be maintained by the City as a public road. No charges will be assessed against <br />the Armstrong property for normal road maintenance or repair. In the event of -^^ecial <br />assessment for improvements to North Arm Lane, the City would ds^ . a .^seisment on <br />the Armstrong homestead property until such time as the property is subaivided or sold. <br />4. The City will accept deeds of conveyance from the Haglunds, Smiths and Sladeks for road <br />access to North Arm Drive. The Haglund dedication will appear on the formal plat as a <br />public road dedication. <br />This agreement was brought to the Council's attention as an information item in the April 12 agenda <br />packet, and should be formally ratified by Council action. The City Anomey has been working <br />with the Armstrong’s attorney to formalize documents to complete this agreement.
