An <br />agreement has been reached with regards to City acquisition of North Arm Lane as a public road, <br />subject to final execution of the various obligations of the agreement (see below). The applicants <br />are requesting final plat approval, which staff recommends granting subject to a number of <br />conditions as outlined in the attached Resolution, Exhibit A. <br />Stormwater Pond <br />Pursuant to the City's requirement that this site be provided with a stormwater pond, and based on <br />the applicant's willingness to provide one as an amenity, a small stormwater pond will be constructed <br />near the southeast comer of Lot 1 . The MCWD granted a variance to their Rule B standards then in <br />effect (June 1998) and did not require a stormwater pond nor monetary contribution. <br />The Resolution is written to require a Developers Agreement and security for construction of this <br />pond. If Council so chooses, this condition could be changed to require the pond be constructed at <br />the time a building permit is issued as part of the site grading for a new residence on Lot 1, avoiding <br />the need for a letter of credit for what is a ^’ery minor grading project...
