2. <br />Subdivider hereby warrants that evidence of title to the property that is acceptable <br />to the City will be provided before approval of the final plat. <br />Improvements. In accordance with the policies and ordinances of the City, the <br />following described public or private improvements (hereinafter collectively called <br />the "Improvements") shall be constructed and installed on the terms and conditions <br />hereinafter contained: <br />Improvements to be installed by Subdivider at Subdivider's expense, with the <br />exception of a future extension of Livingston Avenue to the west property <br />line, shall hereinafter be referred to as "Plan A Improvements". <br />B The future extension of Livingston Avenue to the west property line shall <br />hereinafter be referred to as "Plan B Improvements". <br />3. Plan A Improvements <br />A.Improvements. The Subdivider will construct and install at Subdivider's <br />expense Plan A Improvements according to the terms of this agreement and <br />the terms and conditions as set forth in drawings and specifications as listed <br />in Exhibit D attached hereto. The Plan A Improvements include the <br />following: <br />Site grading, drainage and erosion control improvement including, <br />but not limited to storm sewers and appurtenances, a stormwater <br />pond, grading for building pads, and all necessary erosion control <br />procedures per the approved plans prepared by Westwood <br />Engineering Service, dated ____________, most revised date <br />attached as Exhibit C, pages <br />Installation of public and private roads including street grading, base <br />and permanent surfacing including curb and gutter per the approved <br />plans and specifications attached as Exhibit C, pages_____. <br />(3) Sanitary sewer lines and appurtenances and water service <br />(hereinafter, sewer and water improvements) per the approved plans <br />and specifications attached as Exhibit C, pages___. <br />Landscaping improvements, including trails, boulevard sodding, tree <br />planting, seeding per the approved plan in Exhibit D, per <br />recommendations of Wallace Case, DSU, as outlined in the memo <br />dated February 26, 1999, attached as Exhibit E.
